These Terms of Service ("Terms") govern the use of the AI Tutor History service ("the Service"), provided by Warmer Sun Education ("We," "Us," or "Our"). By purchasing and using the Service, you ("User," "You," or "Your") agree to be bound by these Terms, our Privacy Policy, and any other related document referenced herein.
The Service is offered on a usage-based model. Users purchase license keys that grant a specified number of metered calls to the Service. There are no recurring subscription fees.
The Service is intended for use by the purchasing User only. Users are responsible for maintaining the confidentiality of their login credentials and are fully responsible for all activities that occur under their account. Sharing account credentials or license keys is strictly prohibited and constitutes a violation of these Terms.
The Service is intended solely for personal, non-professional use.
To access the Service, Users must register with a valid email address or social accounts (Google, Microsoft). When using social accounts, the email associated with those accounts will be made available to us. Users must agree to payment processing through our designated payment processor. Payment details are processed and stored by the payment processor and are not accessible by Warmer Sun Education. Users are responsible for keeping their contact and payment details up to date.

Any violation of the above may result in immediate termination of access to the Service, without refund, and may subject the User to legal action.
Users agree to pay the applicable fees for the license keys as set forth on our website. All sales are final, and fees are non-refundable, except at our sole discretion. We reserve the right to change the pricing of license keys at any time, with prior notice to the Users.
We reserve the right to suspend or terminate the access of any User who violates these Terms. Upon termination, the User will lose access to the Service immediately, and no refund will be provided.
To the fullest extent permitted by law, in no event shall Warmer Sun Education be liable for any damages, including without limitation, direct, indirect, incidental, special, consequential, or exemplary damages, arising out of, or in connection with the use of the Service, beyond the amount paid by the User for the license key in the month in which the event giving rise to the liability occurred.
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein, and any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of British Columbia.
We reserve the right to modify or replace these Terms at any time. Users will be notified of significant changes through notifications on our website or via email. It is the user's responsibility to review these Terms periodically for any changes. Continued use of the Service following the posting of changes will mean that you accept and agree to the changes.
Warmer Sun Education shall not be liable for any failure to perform its obligations hereunder where the failure results from any cause beyond Warmer Sun Education’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.
